Regulations
The present document is an integral part of the appropriate agreement
on granting of MCC services for MCC official members.
1. Subject
1.1. The present document gives an official treatment to the basic
concepts and regulates the relations between "Operator" and "Subscriber".
2. Basic regulations
2.1. The present regulations is an unilateral document of "Operator".
2.2. The regulations extend on all "Subscribers" without
fail, it is made and changed by "Operator".
3. Definitions
3.1. Moldova Ñyber Community, is the name of a national Portal
that is also an international informational resource about the
Republic of Moldova on the Internet. The operator of the Portal
is MEGADAT.COM International S.R.L. Company.
3.2. Moldova.CC is an official abbreviation and a registered trademark
that belongs to MEGADAT.COM International S.R.L. Company. The
abbreviation is MCC.
3.3. MCC Credit Card is a banking card of international standard
VISA Electron, or Cyrus Maestro, emitted by "Operator",
in order the "Subscribers" to use it as a personal
electronic payment tool.
4. Membership
4.1. "Operator" determines two types of membership:
anonymous and official.
4.2. Every citizen of Republic of Moldova and the person who lives
in Moldova may become an official member of Moldova Cyber Community.
4.3. In order to become an official member of MCC, it is necessary
to pass an interactive registration at Moldova Cyber Community
Centre, with the obligatory conclusion of the written agreement.
Every official member of the Community, by subscribing on any
MCC service package(or becoming MCC "Subscriber"),
receives Moldova Cyber Community Îfficial Member status and has
the right to use the official logo and corresponding attributes.
4.4. Anonymous member of the Community can become any person.
In order to become an anonymous member of the Community, it is
required to register on the Portal on-line, where it is not necessary
to indicate your real name and surname. Every anonymous member
of the Community receives the Moldova Cyber Community Anonymous
Member status and has the right to use its official logo and
corresponding attributes.
5. Registration
5.1. At registration "Subscriber" should pass a certain
technological process at MCC Centre. For this purpose, it is
necessary to visit Moldova Cyber Community Centre and the first
step is to familiarize with MCC terms. You may find the necessary
documents in one of information folders: folder number 1.
5.2. Further, it is necessary to fill in and to sign the contract
and the questionnaire of the subscriber, you may find them at
the desk number 2. At registration the presence of the identification
card is obligatory.
5.3. Then, for MCC registration, with the signed documents it
is necessary to approach the basic desk number 3. Choose the
personal Internet - address and specify the passwords. Pay MCC
services and fill in applications in order to receive MCC Credit
Card (only if you want to receive it).
5.4. Afterwards, the "Subscriber" should customize the
computer in order to have access to the Internet and to MCÑ services,
using the customizing guide. Access to Internet and to MCC services
is granted for "Subscriber" right after registration.
5.5. In case if you filled in application to receive MCC Credit
Card, the "Subscriber" should visit, in the terms specified
by "Operator", Moldova Cyber Community Centre and he
has to approach Victoriabank desk number 5 and to receive MCC
Credit Card. The presence of identification card is obligatory.
6. Responsibility
6.1. "Parties" are relieved from the responsibility
for partial or complete default from obligations of the present
agreement, if it was a consequence of action of a force majeure.
As force majeure circumstances are considered unforeseen, inevitable
and insuperable to the parties events of extreme character (blaze,
flooding and other natural disasters, and also, binding, even
for one of the parties, decrees, laws or any orders of the Government,
President, Parliament of Republic of Moldova or other state bodies
which make impracticable the present agreement fully or partially).
6.2. "Parties" are obliged not to transmit the rights
and the responsibilities indicated in the agreement to the third
person, without the written agreement of the other party.
6.3. "Parties" are obliged to keep confidentiality of
the service information: name and password of the access to the
Internet, number of the account and the password of access to
the personal account.
7. Restrictions
7.1. "Subscriber" has no right:
• to develop and download into the network software which can
change, damage, destroy the data, program development and the
equipment;
• to remove the data, to infringe work of programs and to forge
messages or to transmit the erroneous data with the purposes
of infringement of data stream or creation of the state of non-confidence
of users;
• to penetrate without authorization and intentionally in the "Operator"'s
systems and networks with the purpose of interception, preservation,
processing or changing of the data and program development, or
damages, destruction of the data, program development and the
equipment;
• to transmit or disclose the confidential information stipulated
by the parties;
7.2. For infringement of MCC services terms of use, "Subscriber" bears
the responsibility according to the current legislation of Republic
of Moldova.
7.3. In case "Subscriber", who uses MCC services, will
cause to the third party damage (material, moral etc.) by illegal
actions or inactivity, "Operator" will not bear any
responsibility for fulfillment of the given actions by "Subscriber".
7.4. Using Internet Portal MCC, the "Subscriber" should
also observe its conditions and restrictions specified in the
Terms of use on the home page of the Portal.
8. Payment
8.1. "Operator" specifies the prices for MCC services
in US dollars, taxes included.
8.2. Payment for MCC services is carried out by advance payment
in Moldavian Lei, according to the exchange rate of National
Bank of Moldova at date of payment.
9. Change of MCC services
9.1. Upon the termination of validity of the agreement on MCC
services, "Subscriber" can conclude
a new contract on use of MCC services. Thus "Operator" keeps
the e-mail address and the name of "Subscriber" web-page
within three months.
9.2. "Subscriber" can change ÌÑÑ service package under
condition of absence of debts and payment of the difference of
packages cost. In this case, it is necessary to fill in the appropriate
application.
10. Coordinates
10.1. The Internet-Portal is accessible on the following official
registered address: http://www.mcc.md.
10.2. Operator distributed the following official domains:
• Moldova.cc - for the anonymous members of the Community,
• Mcc.md and Moldovacc.md - for the use of the official MCC members.
10.3. Every registered member of the Community receives a unique contact coordinates: as personal www-address and e-mail address. For instance, the unique contact coordinates of an anonymous member of the Community Alex by name will be: alex@moldova.cc and http://moldova.cc/alex, and the coordinates of an official member of Community Serg by name will be: serg@mcc.md (or serg@moldovacc.md) and http://mcc.md/serg (or http://moldovacc.md/serg).
11. Service
11.1. The "Subscriber" gets within the framework of
a chosen package the access to the specialized support service
- MCC Hotline. Access to this service is possible by means of
telephone service on the phone: 4-55555, GSM: 794-55555 and e-mail
on the address: hotline@moldovacc.md. This service works non-stop,
twenty four hours a day and without days off, thus being constantly
accessible for MÑÑ "Subscribers".
11.2. Direct service is carried out at Moldova Cyber Community Centre on the address: Chisinau, 73 Stefan cel Mare Avenue; Balti, 24 Independentei Street.
